Breeders’ Rights
New plant varieties are protected through a special Intellectual Property system, the UPOV (International Union for the Protection of New Varieties of Plants) is the organization in charge of ensuring the protection of these plant varieties. To obtain the registration of a new variety, it must comply the requirements of Novelty, Denomination in conformity with internationally accepted guidelines, Distinctness, Uniformity, and Stability, the last three requirements being evaluated through the DUS Testing (Distinctness, Uniformity and Stability Testing). In Chile, the authority in charge of registering these new plant varieties is the Seed Division of the Agriculture and Livestock Service. JarryIP has a team trained to advise our clients on the entire process of new plant varieties, from the application for registration to its registration, both for trees and vines, as well as for other plant varieties.
